Black Hawk Lake Protective Association Being Formed
Lake View, IA -- A group of future-focused area residents concerned with the long-term health of Black Hawk Lake are in the final stages of forming an advocacy group for the lake. The Black Hawk Lake Protective Association (BHLPA) is looking to engage area homeowners, businesses, farmers/landowners and users of Black Hawk Lake to advocate and promote the general welfare of the lake and surrounding environment.
This association is actually an evolution of a 501(c)3 non-profit group that was formed in 2008 to help raise funds for a Black Hawk Lake Diagnostic Feasibility (DF) study. Since the completion of the DF study, a TMDL (Total Maximum Daily Load) study has also been done and both provided information that helped local agencies develop a 30 year plan for watershed improvement. The watershed was recently awarded a grant to begin funding the improvement plan.
To hear more about the efforts that are underway to improve water quality at Black Hawk Lake, attend the BHLPA public meeting on Saturday, August 6th, beginning at 9:00 a.m. at the open shelter house near the Town Bay boat ramp. In the case of inclement weather, the meeting will take place at the City Hall meeting room. Anyone who has an interest in the lake is encouraged to attend.

Tracey Richter-Roberts ordered held without bond in death of Dustin Wehde after a 22 minute closed hearing
Sac City, Iowa – July 29, 2011
At 11:26AM on July 29, 2011 45 year old Tracey Richter-Roberts made her initial appearance in Sac County Magistrate Court this morning to ask to be release on her own recognizance. Roberts has been accused of murdering 20 year old Dustin Wehde in 2001.
Roberts appeared in a one piece orange jumpsuit and seemed to exhibit signs of nervousness manifested by a shaky voice and a request to sit during the proceeding due to her claim that she felt light-headed.
In the presence of the Sac County Attorney, Ben Smith, the Sac County Sheriff, Ken McClure, and Deputy Dan Bruscher, Sac County Judicial Magistrate Warren Bush gave to Roberts a copy of and reviewed the compliant against her. As the judge reviewed the possible punishment for a finding of guilt for murder in the first degree, namely that she could receive life in prison without the possibility of parole, unless the sentence is commuted, Roberts informed the judge that she felt light-headed and asked to sit for the remainder of the proceeding.
Roberts asked to await the arrival of her lawyer, whom she claimed was en-route. Judge Bush clarified for her that the proceeding was an initial appearance one of the purposes of which was to inform her that she had a right to a lawyer and review options should she not be able to afford one.
As the proceeding moved to the question of bail, Sac County Attorney Ben Smith asked that Roberts be asked for a one million dollar cash bond. Judge Bush seemed to dispute the need for a cash bond and was ready to set a surety bond in the amount of one million which would have allowed Roberts to bond out with one hundred thousand dollars in cash. Smith argued that Roberts was a flight risk and a danger to the community but was reluctant to present either evidence of or a professional opinion to back up either of those claims in the presence of media and requested that the proceedings be closed. Judge Warren Bush ordered the public out of the courtroom at 11:45AM.
For the next two minutes the raised voices of County Attorney Smith and the accused could be heard outside of the courtroom, but no actual words could be made out. At 11:47AM County Attorney Smith exited the courtroom abruptly. He returned at 11:48 with a brown package that barely fit underneath his arm. After Smith’s return, no more raised voices could be heard outside of the courtroom.
Judge Bush made the ruling that Roberts was to be held without bond without inviting the public back into the courtroom to witness the ruling.
Judge Bush reviewed his ruling with media only after the proceeding was complete at 12:07PM.

The Sac County Board of Supervisors met in regular session with all members present, Jack Bensley, Chairman, presiding. The minutes of the last meeting were approved as submitted.
It was moved by Hecht and seconded by Stock to amend the agenda to consider a corrective transfer. Ayes all, motion carried.
It was moved by Stock and seconded by Hecht to approve the agenda as amended. Ayes all, motion carried.
It was moved by Hecht and seconded by Stock to approve the transfer of $27,800.00 from General Basic Fund to General Supplemental Fund as a corrective transfer for fiscal year 2010/11. Ayes all, motion carried.
It was moved by Stock and seconded by Hecht to re-appoint Shirley Phillips to the Western Iowa Tourism Council. Ayes all motion carried.
Lisa Bethune, Sac County CPC, presented and explained the 2011/12 cost report and case management rates.
It was moved by Stock and seconded by Hecht to approve a Provider and Program Participation agreement with Mary Greeley Hospital in Ames, Iowa for 2011/12. Ayes all, motion carried.
It was moved by Hecht and seconded by Stock to sign a contract for services with Spencer Hospital for 2011/12. Ayes all, motion carried.
It was moved by Hecht and seconded by Stock to sign a contract for services with Counseling Services of Sac City for 2011/12. Ayes all, motion carried.
Jim Frederick updated the Board on the Blackhawk Lake watershed improvement project. It was moved by Hecht and seconded by Stock to provide a letter of support for a WIRB grant and some local effort funds to improve the septic systems in Carvarnon. Ayes all, motion carried.
At 10:30, the Chairman opened the public hearing on redistricting and reprecincting for Sac County as required after each census.
The County Auditor provided a map of proposed supervisor districts as submitted by the re-districting committee. The proposed supervisor districts for Sac County would include in District One: Eureka, Eden, Cook, Boyer Valley, Richland and Wheeler Townships and the Cities of Schaller, Early and Odebolt; District Two: Delaware, Douglas, Jackson, Cedar and Coon Valley Townships except Sections 24, 25, 26, 31, 32, 33, 34, 35, and 36 of Coon Valley Twp; District Three: Clinton, Wall Lake, Levey, Viola, Sac and sections 24, 25, 26, 31, 32, 33, 34, 35, and 36 Coon Valley. There was no one present to support or oppose the proposed district plan. There was brief discussion on combining several precincts in Sac County.
It was moved by Hecht and seconded by Stock to close the public hearing. Ayes all, motion carried.
It was moved by Stock and seconded by Hecht to approve the re-districting plan for Sac County and direct the County Auditor to prepare an ordinance establishing the new supervisor district boundaries. Ayes all, motion carried.
The Sac County Sheriff’s office notified the Board of Supervisors that notice had been received from Chief Deputy Keith Flink of his resignation effective August 2, 2011.
The County Engineer updated the board on activities of the county road crews and the status of current maintenance and construction projects as well as an update on Highway 20.
It was moved by Hecht and seconded by Stock to accept the low bid of $134,835 submitted by Cedar Falls Construction for PCC patching on County Roads M27, M43 and N14. Ayes all, motion carried.
With there being no further business, on motion, the meeting was adjourned.

45 year old Tracey Richter-Roberts has been charged with Murder in the First Degree for the 2001 death of 20 year old Dustin Wehde in Early, Iowa. Richter-Roberts, who was picked up in Douglas County, Nebraska, has waived extradition which means that she is not going to contest extradition back to Sac County, Iowa.
An information request for the time and date of Richter-Roberts transportation to Sac County was not responded to in time for publication.

While at the Sac County Fair taking pictures of people showing goats and chickens and horses this morning, a TSN viewer took me aside and asked me the following question:
When the school board wanted to use a policy to justify removing ESC Principal Mike Fischer from the girl's basketball coaching position, the district was growing, and he was going to have to concentrate on being the principal, but now that the school board wants to institute a brand new tax and max it out for ten years all of a sudden the district is shrinking...
How can both of these be true?

First official information release for Tracey Richter-Roberts Arrest

Sac County, Iowa --- Yesterday, law enforcement arrested 45 year old Tracey Ann Richter-Roberts for the 2001 death of 20 year old Dustin Wehde in Early, Iowa. Richter-Roberts is charged with Murder in the 1st Degree, a Class A Felony. She is currently being held in the Douglas County, Nebraska Jail.
On December 13, 2001 at approximately 7:07 PM, the Sac County Sheriff’s Communication Center received a 911 call requesting assistance at the residence of Michael and Tracey Roberts, 105 W. South Avenue in Early, Iowa. Upon arrival, law enforcement met Tracey Roberts and her three children inside the residence. Wehde was found dead of multiple gunshot wounds in the upstairs master bedroom. Sac County, Iowa --- Yesterday, law enforcement arrested 45 year old Tracey Ann Richter-Roberts for the 2001 death of 20 year old Dustin Wehde in Early, Iowa. Richter-Roberts is charged with Murder in the 1st Degree, a Class A Felony. She is currently being held in the Douglas County, Nebraska Jail.
On December 13, 2001 at approximately 7:07 PM, the Sac County Sheriff’s Communication Center received a 911 call requesting assistance at the residence of Michael and Tracey Roberts, 105 W. South Avenue in Early, Iowa. Upon arrival, law enforcement met Tracey Roberts and her three children inside the residence. Wehde was found dead of multiple gunshot wounds in the upstairs master bedroom. Roberts told investigators Wehde and another, unknown person attacked her, but she was able to secure a handgun, fire and strike Wehde. On Tuesday July 26, 2011, Sac County, Iowa Sheriff Ken McClure along with along with investigators from the Douglas Nebraska Sheriff's Department and the Iowa Division of Investigation executed a vehicle stop on one Tracey A. Richter near the corner of 18th Street and West Center Road in Omaha Nebraska.
Richter, a former resident of Early, Iowa was arrested and accused of First Degree Murder, a Class A felony in the shooting death of 20 year old Dustin Wehde.
According to a 2005 Storm Lake Pilot Tribune story, Richter, who was at the time of the slaying known as Tracey Roberts, shot and killed Dustin Wehde in what Richter claims was self defense on December 13, 2001.

Richter is said to have wounded Dustin Wehde by shooting him with a 9mm. Richter is then said to have retrieved a second gun, and fired three or four bullets from it into the back of Wehde's head, killing him.
According to Sac County Sheriff Ken McClure, the crime was never considered closed. Advances in forensic science prompted a re-examination of the evidence starting in 2009.
Richter awaits extradition to Sac County, Iowa.

It was moved by Stock and seconded by Hecht to approve the drainage claims as submitted. Ayes all, motion carried.
It was moved by Stock and seconded by Hecht to approve an application for underground cable installation in sections 21 and 28, Viola twp within Drainage District 55 submitted by Raccoon Valley Electric Cooperative. Ayes all, motion carried.
It was moved by Hecht and seconded by Stock to approve payment of regular dues $2500.00 to the Iowa Drainage District Association and contribute $1250.00 to the IDDA mutual protection fund. Ayes all, motion carried.
It was moved by Hecht and seconded by Stock to approve an application for expansion to an existing animal confinement unit located in Section 32, Sac Township submitted by Wes Mohr with consideration of no increase in the number of animal units and subject to the approval of the Iowa Dept. of Natural Resources. Ayes all, motion carried.
The County Engineer was not present for the meeting but faxed a report on activities of the county road crews and the status of current maintenance and construction projects.
With there being no further business, on motion, the meeting was adjourned.

East Sac County School Board makes suggestions to the IASB
The Iowa Association of School Boards, (when not acting like sleaze balls with something to hide,) and to whom the current East Sac County School Board members voluntarily give our tax money, also lobby on behalf of the schools in the Iowa legislature.
In order to help the IASB in their efforts in representing their schools, they ask that members contribute their opinions about on which topics they should focus when lobbying. Following is the list of items from which the East Sac County School Board choose four legislative priorities for recommendation. The items that are circled are the items on which the ESC school board wants the IASB to focus in 2012. The items in bold that say "2011 IASB Priority" are the items that the IASB will focus on this year.
The third page of this set of records entitled “Advocacy Survey” is something that the ESC board has been asked to submit to the IASB on a voluntary basis.
