Curtis and Jared,

Enclosed you will find the documents per your open meetings request. Allow me to explain several things regarding the documents released as well as the process I used.
• I have used two computers since coming to ESC; I searched hard drives and email programs on both machines using various search terms, e.g., WLVA Board, Sac Board, ESC Board, All Staff, Faculty, names of Board members, names of administrators/staff
• I also searched all hard files/folders for material mentioned in your request
• All enclosed materials are in their original form other than where a section was redacted for confidentiality reasons (these are “whited-out” in the documents and explained below)
• The only documents not being released are either confidential personnel records or attorney-client privileged communications.
I share this information simply to call your attention to the fact that I have taken your request seriously and have shared everything per your request that I have found.

Before listing and explaining the enclosed documents, I would also like to address the posting on www.thesacnews.com entitled, “Researching East Sac County School Board President Chuck Brotherton’s 1000 emails in real time … .” If you were at the school board meeting, which we both were, or if you watch the video clip regarding this statement, it should be obvious that Mr. Brotherton was using a figure of speech. To assume the comment, especially within the emotional context of the meeting, was literal is just plain silly. I have and will continue to respect your mission and motive with your website; but will not sensationalize an already emotional, important issue. The only emails between Mr. Brotherton and me involve scheduling time to review Board agendas prior to them being sent to the media each month. Since none of those emails referenced Series 300 Board policies I have not included them with the enclosed materials.

Enclosed you will find 27 communications related to your request. There are no other hard copies, text messages, or any other form of archivable communication. I did have a text message conversation with Shirley Phillips in February or March, but I do not keep text messages. I contacted Shirley to see whether she kept the text messages but she did not either. That particular conversation was sharing process information. A couple of notes about the enclosed items:
• Board Policy Proposal … The first time the Board knew about the proposed policy was in February. Based on dates listed in my Outlook Calendar, I met with Board members regarding information on the Instructional Support Levy and the proposed policy as follows:

• Peterson email w redaction 4 22 11 … There was mention of other school personnel which has been redacted.

All other documents are in their original form. As previously mentioned, I have taken your request seriously and responded openly and honestly and included everything I could find.

Dr Fiene,

Thank you for the quick return. It dismays me that by the use of the phrase "1000 emails" you would think that I was doing anything other than using the phrase that is the gentleman's actual words, rather than paraphrasing with what is probably a more accurate but speculative guess at what he meant.

I don't think it is possible to sensationalize this issue any more than it already was after the slanderous March board meeting at which Ms. Kitt spoke. In fact, with specific regard to TSN readers, I'm rather proud of the fact that they held back and saved the really nastily libelous stuff for their own private communications rather than dumping it in my lap.

- I now wish to request a copy of all archived records of any type of communication between you and East Sac County School Board President Chuck Brotherton dating from November 1, 2010 to December 31, 2010 regarding any topic.

- On April 20, 2011 you sent a mass mailing to many staff entitled RE: ***BULK*** board meeting summary. I have a copy of the cover letter, (so to speak,) but you did not include the attachment that was apparently part of this email. I request a copy of that record.

- Additionally, I’d like to request the copy of all of Jared Strong’s, FOIA requests that you received between April 1, 2011 to March 2, 2011.

Again, in the spirit of Iowa’s open records laws please redact if absolutely necessary rather than denying review of the entire record. Please let me know via email what the charge, (if any,) for these records will be.

The last item for today will be a question. Do you provide archival services for all school board director's communications related to board business or are they their own record keepers for their communications with other board members?

All communications are subject to publication.
