Sheriff McClure has a conversation with the Early City Council about noise violations from Willoughby'z




EARLY, IOWA – JULY 6, 2010

Sac County Sheriff Ken McClure reported to the Early City Council that Early, Iowa’s only bar, X, violated its liquor license recently when it was ascertained by the department that they were serving alcohol after hours. McClure said that the owners of the bar claimed they could serve after hours because it was a private party. McClure disagreed with that conclusion.

According to Sheriff McClure, the Sac County Sheriff’s Department has also taken 17 complaints regarding noise from the same location in a two year period, but that less than a handful were after 10:00PM. McClure called this an “…ongoing, continuing problem.”

Under the noise ordinance, the Early City Council has the ability to grant the bar a variance for the noise, essentially legalizing it. As the Sheriff’s Department is under contract with the City of Early, Sheriff McClure’s position is that he was seeking guidance as an employee of the city.

The discussion regarding noise began with City councilperson X stating that he talked to several of the other neighbors, and that those neighbors aren’t bothered by the noise. Sheriff McClure told the council, “I’ve talked to three of the deputies that have come over here. On a rare occasion, [bar patrons will] be standing out front with the door open, somebody smoking. On rare occasions [deputies can] hear it from the street.”

Mayor X chimed in saying that he had gone to the bar himself after receiving a complaint and “:Couldn’t hear nothing… I heard some noise but not that much noise.”

Ultimately, the council was unable to make an immediate decision due to the fact that they had not drawn a quorum.
