Sac County Attorney responds to concerns about sentencing

TSN Viewers,
I contacted the county attorney and informed him of your concerns about sentencing. I asked him if he would like to comment on this case.

The following statement from Sac County Attorney, Ben Smith, refers to the specific post at the following link...

...but in truth is probably true for a very large number of cases.

Mr. Smith's statement is in bold.

After a defendant pleads or is found guilty, the Judge (and only the Judge), who, after considering a number of factors, including the Iowa Department of Correction’s (IDOC) sentence recommendation, decides the sentence. Here, the defendant entered a guilty plea, the IDOC recommended a suspended sentence, and the presiding District Court Judge ordered a suspended sentence. I think you will find the Court’s ruling here in line with similar cases across the state.

I encourage anyone with a question or concern regarding this or any other matter to discuss it with me in-person or over the phone ((712) 662 – 4791). My office, which is on the third floor of the Sac County Courthouse, is open to everyone – just be sure to bring tasty snacks.

  1. Nice touch letting everyone know to bring tasty snacks before they showed up empty handed, and had to go get some before returning!
