Mayor and Council, The Federal, Fair Labor Standards Act and Code of Iowa section 91.A1 forbids an employer, government or private to withhold an employees last paycheck. The employee does have somewhere to go to file a complaint and employers are subject to fines for violations. The last paycheck must be forwarded to the employee on the payday following their resignation. I suggest that the mayor and council revise their current policy re: withholding of an employees paycheck and bring city government into compliance with federal and state laws.
