I contacted the county attorney and informed him of your concerns about sentencing. I asked him if he would like to comment on this case.

After a defendant pleads or is found guilty, the Judge (and only the Judge), who, after considering a number of factors, including the Iowa Department of Correction’s (IDOC) sentence recommendation, decides the sentence. Here, the defendant entered a guilty plea, the IDOC recommended a suspended sentence, and the presiding District Court Judge ordered a suspended sentence. I think you will find the Court’s ruling here in line with similar cases across the state.
